2. What data we collect and for what purpose
a) Booking inquiry
When you send an inquiry via the form on the Reservations page, we collect: first and last name, e-mail address, phone/mobile number, dates of arrival and departure, number of persons, selected apartment and the content of your message.
We use this data exclusively to respond to your inquiry, communicate about availability and arrange your booking. Legal basis: taking steps at your request prior to entering into a contract and performance of the accommodation contract (Art. 6(1)(b) GDPR).
b) Communication by e-mail and phone
If you contact us directly by e-mail or phone, we process the data you provide on that occasion (name, contact details, content of the message) in order to respond to your inquiry. Legal basis: taking steps prior to entering into a contract (Art. 6(1)(b)) or our legitimate interest in communicating with guests and interested persons (Art. 6(1)(f)).
c) Guest registration (eVisitor)
Upon your arrival, as an accommodation provider we are legally obliged to collect and register guest data in the eVisitor system (the Croatian National Tourist Board’s system for the registration of tourists): first and last name, date and place of birth, citizenship, type and number of identification document, place of residence, and dates of arrival and departure.
Legal basis: compliance with our legal obligations (Art. 6(1)(c) GDPR) under the Croatian Hospitality and Catering Industry Act and the Tourist Tax Act.
d) Invoicing
For issuing invoices for accommodation services, we process the data required under tax regulations. Legal basis: compliance with legal obligations (Art. 6(1)(c) GDPR).
e) Technical data about your visit
When you visit the website, the server hosting the site automatically logs technical data such as your IP address, browser type, and the date and time of access. This data is used to ensure the technical functionality and security of the website. Legal basis: our legitimate interest in the secure and proper functioning of the website (Art. 6(1)(f) GDPR).
3. Cookies
Our website uses cookies — small text files stored on your device when you visit the site. On your first visit, a cookie notice is displayed allowing you to accept all cookies, reject all non-essential cookies, or adjust your preferences by category:
- Necessary cookies — enable basic site functions such as storing your privacy preferences. They are always active because the site cannot function properly without them, and no consent is required for them.
- Functional cookies — support additional features such as embedded third-party content. They are activated only with your consent.
- Analytics cookies — used to track site traffic and how the site is used. They are activated only with your consent.
- Marketing cookies — used to display personalised content and measure advertising effectiveness. They are activated only with your consent.
The legal basis for non-essential cookies is your consent (Art. 6(1)(a) GDPR), which you may withdraw or change at any time by clicking the cookie settings icon in the bottom left corner of the site. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.
Third-party content
The site embeds a Google Maps map (Google Ireland Ltd.) to show the location of the apartments. When the map loads, Google may set its own cookies and collect data about your device and behaviour. More information is available in Google’s privacy policy: https://policies.google.com/privacy
4. Who has access to your data
We do not sell your data or share it with third parties for marketing purposes. Access to the data may be granted exclusively to:
- Our hosting and e-mail provider (Hostinger), on whose servers the website and e-mail inbox are located — acting as a data processor
- The Croatian National Tourist Board and competent authorities via the eVisitor system — based on a legal obligation
- The Tax Administration and other competent authorities — where required by law
5. Transfers of data to third countries
Your data is generally processed within the European Union. When embedded Google services (Google Maps) are used, data may be transferred to the USA; Google participates in the EU-U.S. Data Privacy Framework, which ensures an adequate level of data protection.
6. How long we keep your data
- Booking inquiries that did not result in a stay: deleted no later than one year after the last communication
- Guest and stay data: kept for the periods prescribed by the Croatian Hospitality and Catering Industry Act and the Tourist Tax Act
- Invoices and data for tax purposes: kept for the periods prescribed by tax regulations
- Cookies: for the periods stated in the cookie settings, or until consent is withdrawn
After the above periods expire, the data is deleted or anonymised.
7. Your rights
In relation to the processing of your personal data, you have the following rights:
- Right of access — you may request information on whether and which of your data we process
- Right to rectification — you may request the correction of inaccurate or completion of incomplete data
- Right to erasure (“right to be forgotten”) — you may request deletion of data when there is no longer a legal basis for processing
- Right to restriction of processing — in certain cases you may request that processing be restricted
- Right to data portability — you may request the data you provided to us in a structured, machine-readable format
- Right to object — you may object to processing based on legitimate interest
- Right to withdraw consent — you may withdraw consent (e.g. for cookies) at any time
To exercise your rights, contact us at info@apartmani-gujic.eu. We will respond to your request without undue delay and at the latest within one month.
If you believe that the processing of your data has violated any of your rights, you have the right to lodge a complaint with the supervisory authority: Croatian Personal Data Protection Agency (AZOP), Selska cesta 136, 10000 Zagreb, www.azop.hr, e-mail: azop@azop.hr.
8. Data security
We apply appropriate technical and organisational data protection measures, including an encrypted connection (HTTPS/SSL) on the website, restricted access to data and regular system updates. We do not store inquiry data longer than necessary for the stated purposes.
9. Minors
Our website and services are intended for adults. We do not knowingly collect personal data of minors without the consent of a parent or guardian. We process data about minor guests exclusively within the scope of the legal obligation to register stays, based on data provided by the adult making the booking.
10. Changes to this policy
We may update this privacy policy from time to time to reflect changes in regulations or in how we operate. The current version is always published on this page with the date of the last update indicated.
